What are Muncie City Public Records?

According to the Indiana Access to Public Records Act, Muncie City public records are records created, retained, filed, or received by public agencies. Records may exist as papers, writings, reports, maps, photographs, books, or other materials regardless of physical form or characteristics.

The Public Records Act specifies that any person may inspect or copy public records from the relevant custodian agency by submitting official requests as preferred by the agency. Indiana law also allows persons denied access to public records to seek redress in the Delaware County Circuit or Superior Courts. However, members of the general public cannot obtain the following information:

  • Trade secrets that derive economic value from scarcity or general unavailability
  • Attorney work products
  • Autopsy video or audio recordings and photographs
  • Confidential financial information
  • Research records conducted with help or support from a university or state college
  • Records declared confidential by the Supreme Court of Indiana
  • A patient's medical records unless where the patient provides written consent as provided by law
  • Social security numbers contained in an agency's records

In addition to the above, Indiana law also allows several exemptions at the custodian agency's discretion. Some examples include:

  • Examination records, such as scoring keys and test questions unless no longer scheduled for future examinations
  • Law enforcement investigatory records
  • Test scores that identify the person's name if the person has not provided consent
  • Inter-agency or intra-agency deliberative or advisory records that contain opinions or are speculative and produced or transferred for decision-making purposes
  • Personnel files of current or prospective public employees. However, this exemption does not cover certain information, such as the person's name, job title, compensation, job description, previous work experience, and information about disciplinary proceedings or actions against the person
  • Records identifying a public agency's donor if confidentiality is a part of the agreement
  • Plans systems and measures developed for school security and safety
  • Criminal intelligence records

In addition to government agencies, some public records may also be accessible from third-party websites. These non-government platforms come with intuitive tools that allow for expansive searches. Record seekers may either opt to use these tools to search for a specific record or multiple records. However, users will need to provide enough information to assist with the search, such as:

  • The name of the subject involved in record (subject must be older than 18 or not juvenile)
  • The address of the requestor
  • A case number or file number (if known)
  • The location of the document or person involved
  • The last known or current address of the registrant

Third-party sites are not sponsored by government agencies. Because of this, record availability and results may vary.
